Understanding what to expect with a divorce

In general, there are two types of divorce cases.  These are referred to as an uncontested or contested divorce.  As the names imply an uncontested divorce is where both parties can agree on everything prior to trial and no litigation is required.  A contested divorce is where the separated couple has disagreements on some or several key issues and these differences must be resolved by a judge or via mediation.  As a basic rule, divorce is easier to achieve is the marriage was relatively short, there are no children involved, and there has not been much by way of marital property that was accrued while the marriage was intact.

Key Items to consider:

A dissolution of marriage is not just two people ending a relationship.  It is legally and fairly terminating a contract where both parties can attempt to move on with impacts limited on their personal lives as much as possible.  Although there is no magic wand to their process as though the marriage never happened, it is possible to protect your life, your assets and your rights as a parent with the right lawyer on your side.  Typical concerns include these essential items:

  • Property division
  • Alimony or spousal support
  • Child Support
  • Visitation and child custody
  • Protective orders and domestic violence issues
  • Paternity
  • Modification of Orders
  • Prenuptial agreements
